Terms & Conditions of Sale – Oh Sew Gecko

1. Introduction

1.1 These Terms & Conditions govern the sale and purchase of products through our website www.ohsewgecko.com.
1.2 By placing an order on our website, you agree to these Terms & Conditions.
1.3 These Terms do not affect your statutory rights as a consumer under EU law.

2. Interpretation

2.1 “We”, “us” and “our” refers to Oh Sew Gecko, owned by Lisa Linton.
2.2 “You” and “your” refers to our customer or prospective customer.

3. Products

3.1 Our products include:

• Cork fabric and sewing supplies.

• PDF sewing patterns (digital downloads).

• Handmade cork accessories (such as bags).

• Gift cards.

3.2 We may update or change the range of products available at any time.

4. Prices & Currency

4.1 Prices are stated on our website in Euros (€).
4.2 All prices are inclusive of VAT (where applicable).
4.3 Prices may change, but will not affect confirmed orders.
4.4 Delivery charges may apply and will be shown before checkout.
4.5 If your card or PayPal account is in another currency, your provider may charge a conversion fee.

5. Payments

5.1 Payments are processed securely via Stripe and PayPal.
5.2 Payment must be made in full at checkout.
5.3 If payment is not received, your order may be cancelled.
5.4 Unjustified chargebacks may make you liable for associated costs.

6. Orders & Delivery

6.1 Orders are confirmed once payment is received.
6.2 We ship via Correos Carta Certificada (Large Letter Signed For) and FedEx for some international orders.
6.3 Pre-orders are delivered within 4 weeks of the pre-order closing date.
6.4 Fabrics are shipped rolled (not folded). Unless agreed otherwise, multiple quantities are sent as separate cuts, not continuous length.
6.5 Delivery times vary by destination and local postal service. Customs duties, import taxes, and handling fees outside the EU are the buyer’s responsibility.
6.6 If you refuse to accept delivery of an order, including refusal to pay customs duties, or if the parcel is uncollected and returned to us, you are not eligible for a refund of the original shipping costs. Any return shipping fees charged to us by the carrier will also be deducted from your refund.
6.7 Risk of loss passes to you once the product has been handed over to the postal service.

7. Cancellation & Returns

7.1 You have the right to cancel or return unused, unopened physical products within 14 days of receipt.
7.2 To request a return, you must contact us first at returns@ohsewgecko.com.
7.3 Customers are responsible for return shipping costs, unless the product is faulty or we made an error.
7.4 Refunds are issued after inspection, within 5 business days, to your original payment method (excluding shipping costs). Refunds may take longer during public holidays or temporary shop closures.
7.5 Digital downloads (PDF patterns) are non-refundable once downloaded.
7.6 Handmade bags may be returned within 14 days if unused/unworn and in original condition.
7.7 Custom or personalised items cannot be returned or cancelled unless defective.
7.8 Gift cards are non-refundable.

8. Gift Cards

8.1 Gift cards can be used towards the purchase of Oh Sew Gecko products (fabric, handmade items, PDF patterns).
8.2 Gift cards cannot be used to pay for shipping costs.
8.3 If applied to a pre-order, the same pre-order delivery timelines apply.
8.4 Gift cards are valid for 12 months from the date of purchase.
8.5 Gift cards are non-refundable and cannot be exchanged for cash.

9. Digital Products & Intellectual Property

9.1 All PDF sewing patterns and digital downloads are protected by copyright.
9.2 Customers are granted a personal, non-transferable licence to use patterns for individual sewing.
9.3 Finished products may be sold on a small, artisan scale but not for mass production or wholesale.
9.4 Patterns must not be shared, resold, redistributed, or uploaded online.
9.5 Teaching or group workshops using our patterns is permitted only if each participant has purchased their own copy.
9.6 Video or tutorial content based on our patterns requires prior written permission.

9.7 Usage Rights for Cork Fabric Panels

9.7.1 All cork fabric panel designs sold by Oh Sew Gecko are original artworks created by Lisa Linton and are protected by copyright law. While the stories and characters of Alice in Wonderland are in the public domain, the panel designs themselves are unique works and remain the intellectual property of Oh Sew Gecko.
9.7.2 By purchasing cork fabric panels, you are granted the following rights:

• You may use the panels in your personal sewing projects.

• You may sell finished handmade items (such as bags or accessories) created using these panels.

9.7.3 You are not permitted to:

• Copy, scan, print, or otherwise reproduce the panel designs.

• Sell, share, or distribute the digital or physical artwork of the panels themselves.

9.7.4 This usage agreement allows makers to freely sell their finished handmade creations while ensuring the originality and value of the panel artwork remains protected.
9.7.5 In short: sew freely, sell your creations, but please do not copy the panel artwork itself.

10. Limitations on Orders

10.1 We reserve the right to limit order quantities.
10.2 We may refuse orders that appear intended for resale or wholesale distribution.

11. Warranties

11.1 We warrant that the products correspond to their description, are of satisfactory quality, and free from legal encumbrances.
11.2 Natural variations in cork fabric colour and texture are not defects. Colours may differ slightly due to screen settings and lighting.

12. Liability

12.1 Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence.
12.2 We are not liable for business losses, indirect damages, or losses arising from misuse of products.
12.3 Our liability is limited to the value of the order.

13. Accounts & Security

13.1 If you create an account, you are responsible for maintaining the confidentiality of your login details.
13.2 You are responsible for all activity conducted under your account.

14. Promotions & Discounts

14.1 Promotions, discount codes, and special offers cannot be applied to past orders.
14.2 We may withdraw promotions at any time.

15. Force Majeure

15.1 We are not responsible for delays or failure to perform caused by events beyond our reasonable control, such as postal strikes, natural disasters, or internet outages.

16. Age Restrictions

16.1 By placing an order, you confirm that you are at least 18 years old or have parental/guardian permission.

17. Shipping Restrictions

17.1 We currently ship to Spain, the EU, the UK, Canada, Australia, New Zealand, and the USA. If your country is not listed at checkout, please contact us at info@ohsewgecko.com to discuss available options.
17.2 We reserve the right to update available shipping destinations at any time.

18. Governing Law & Jurisdiction

18.1 These Terms are governed by Spanish law.
18.2 Any disputes shall be subject to the jurisdiction of the courts of Spain.

19. Severability

19.1 If any part of these Terms is found invalid, the remaining sections remain in effect.
